These terms govern the use of fantapredio, the collectible-card fantasy football game (the app and this site). By using the service you confirm you have read and accepted them. Together with the Privacy Policy they form the agreement between you and the provider.

1. Who provides the service

The service is provided by Matteo Vanzini, Via Carso 63, 41013 Castelfranco Emilia (MO), Italy. Contact: support@fantapredio.com.

2. What fantapredio is

fantapredio is an entertainment game. You build a card collection, field a line-up, earn points based on the players’ real match ratings and climb the rankings. It is not a betting service and not a game with monetary winnings.

3. Age requirement and account

• To play you must register an account, via email or through Apple or Google.
• You must be at least 14 years old (the Italian age of consent for online services); under-14s may use the service only with the consent of the holder of parental responsibility.
• You are responsible for keeping your credentials confidential and for activity carried out with your account.
• The information you provide (e.g. username, team name) must be truthful, not misleading, not offensive and must not infringe third-party rights: we may moderate or remove it.

4. Credits and virtual content

• Credits, cards and other in-game content are granted under a limited, personal, revocable licence within the service.
• They have no monetary value, are non-refundable, cannot be converted into money and cannot be transferred outside the game.
• Credits are earned solely by playing and cannot be bought with real money: opening packs and predictions use only virtual credits with no economic value. The service involves no in-app purchases and no real-money transactions.

5. Packs and random draws

Opening a pack is a random draw: you receive cards according to probabilities disclosed in the app before purchase. The outcome is random and no specific card or rarity is guaranteed.

6. Predictions (not gambling)

The predictions feature uses in-game credits only, which have no monetary value. It involves no real money, pays no cash winnings and allows no conversion into real currency. Lacking the money stake required by Art. 721 of the Italian Criminal Code, it does not constitute gambling or betting subject to ADM licensing.

7. Intellectual property

The fantapredio name, the logo, the cards, the graphics, the texts and the other content of the service belong to the provider or its respective licensors and are protected by copyright and trademark law. We grant you a personal, non-exclusive, non-transferable licence to use the service for personal entertainment. Real players’ names and images are used under specific consents (see Privacy Policy).

8. Fair use

You agree not to: alter or tamper with the game; use bots, exploits or automated means to gain an advantage; decompile or reverse-engineer; resell or transfer the account or the content; use the service for unlawful purposes or to the detriment of third parties.

9. Suspension and closure

We may suspend or close an account that breaches these terms or endangers the security and proper operation of the game. You may request deletion of your account at any time.

10. The game may change

As a live game, content, cards, credit economy, probabilities and balancing may be changed, updated or discontinued. We will inform you of material changes to these terms; continued use of the service constitutes acceptance.

11. Warranties and liability

The service is provided “as is” and “as available”. To the extent permitted by law we exclude implied warranties and are not liable for interruptions, faults or data loss not attributable to us. Nothing in these terms limits or excludes our liability for wilful misconduct or gross negligence, for personal injury, or the mandatory statutory rights granted to consumers.

12. Consumers, withdrawal, governing law and venue

If you use the service as a consumer, the mandatory rights of the Italian Consumer Code (Legislative Decree 206/2005) remain unaffected. For any digital content purchased, the right of withdrawal (Art. 52 Consumer Code) is lost where performance begins with your express consent and acknowledgement of that loss (Art. 59(o)). These terms are governed by Italian law; for consumer disputes the competent court is that of the consumer’s residence or domicile.

13. Relationship with the app stores

The app is distributed via the App Store and Google Play. These stores are not party to this agreement; any purchases and related refunds follow the terms of the store through which the purchase is made.

2. Cos’è fantapredio

fantapredio è un gioco di intrattenimento. Costruisci una collezione di carte, schieri una formazione, guadagni punti in base ai voti reali dei giocatori e scali le classifiche. Non è un servizio di scommesse né una piattaforma di gioco con vincite in denaro.

3. Requisiti di età e account

• Per giocare devi registrare un account, via email oppure tramite Apple o Google.
• Devi avere almeno 14 anni (soglia italiana per il consenso ai servizi online); i minori di 14 anni possono usare il servizio solo con il consenso di chi esercita la responsabilità genitoriale.
• Sei responsabile della riservatezza delle tue credenziali e delle attività svolte con il tuo account.
• Le informazioni che fornisci (es. nome utente, nome squadra) devono essere veritiere, non ingannevoli, non offensive e non lesive di diritti di terzi: possiamo moderarle o rimuoverle.

4. Crediti e contenuti virtuali

• I crediti, le carte e gli altri contenuti di gioco sono concessi in licenza d’uso limitata, personale e revocabile all’interno del servizio.
• Non hanno valore monetario, non sono rimborsabili, non sono convertibili in denaro e non sono trasferibili al di fuori del gioco.
• I crediti si ottengono esclusivamente giocando e non sono acquistabili con denaro reale: l’apertura dei pacchetti e i pronostici utilizzano solo crediti virtuali privi di valore economico. Il servizio non prevede acquisti in-app né transazioni con denaro reale.

5. Pacchetti ed estrazioni casuali

L’apertura di un pacchetto è un’estrazione casuale: ricevi carte in base a probabilità dichiarate nell’app prima dell’acquisto. L’esito è aleatorio e non è garantita alcuna carta o rarità specifica.

6. Pronostici (non è gioco d’azzardo)

La funzione di pronostici utilizza esclusivamente crediti di gioco privi di valore monetario. Non comporta l’uso di denaro reale, non eroga vincite in denaro e non prevede alcuna conversione in valuta reale. Mancando la posta in denaro richiesta dall’art. 721 del Codice penale, non costituisce gioco d’azzardo né attività di scommessa soggetta a concessione ADM.

7. Proprietà intellettuale

Il nome fantapredio, il logo, le carte, la grafica, i testi e gli altri contenuti del servizio sono di proprietà del titolare o dei rispettivi licenzianti e sono protetti dal diritto d’autore e dalla disciplina dei marchi. Ti concediamo una licenza personale, non esclusiva e non trasferibile per usare il servizio a fini di intrattenimento personale. Nomi e immagini dei giocatori reali sono utilizzati sulla base di appositi consensi (vedi Privacy policy).

8. Uso corretto

Ti impegni a non: alterare o manomettere il gioco; usare bot, exploit o mezzi automatizzati per ottenere vantaggi; decompilare o effettuare reverse engineering; rivendere o cedere l’account o i contenuti; usare il servizio per scopi illeciti o lesivi di terzi.

9. Sospensione e chiusura

Possiamo sospendere o chiudere un account che violi questi termini o comprometta la sicurezza e il corretto funzionamento del gioco. Puoi chiedere in ogni momento la cancellazione del tuo account.

10. Il gioco può cambiare

Trattandosi di un gioco vivo, contenuti, carte, economia dei crediti, probabilità e bilanciamento possono essere modificati, aggiornati o interrotti. Ti informeremo delle modifiche rilevanti a questi termini; l’uso successivo del servizio ne implica l’accettazione.

11. Garanzie e responsabilità

Il servizio è fornito “così com’è” e “come disponibile”. Nei limiti consentiti dalla legge escludiamo le garanzie implicite e non rispondiamo di interruzioni, malfunzionamenti o perdita di dati non imputabili a nostra colpa. Nulla in questi termini limita o esclude la nostra responsabilità per dolo o colpa grave, per danni alla persona, o i diritti inderogabili riconosciuti ai consumatori dalla legge.

12. Consumatori, recesso, legge applicabile e foro

Se usi il servizio come consumatore, restano fermi i diritti inderogabili del Codice del Consumo (D.lgs. 206/2005). Per i contenuti digitali eventualmente acquistati, il diritto di recesso (art. 52 Cod. Consumo) si estingue se l’esecuzione è iniziata con il tuo espresso consenso e con la presa d’atto della perdita del recesso (art. 59, lett. o). Questi termini sono regolati dalla legge italiana; per le controversie con i consumatori è competente il foro del luogo di residenza o domicilio del consumatore.

13. Rapporto con gli store

L’app è distribuita tramite App Store e Google Play. Tali store non sono parte di questo accordo; eventuali acquisti e relativi rimborsi seguono le condizioni dello store attraverso cui l’acquisto è effettuato.
